Updated 29 March 2022

You are using the Untitled website (“Website”), and these Site Terms & Conditions (‘Terms’) apply from 9 August 2021. Please read these Terms carefully. Please do not use this Website if you do not agree to these Terms as these Terms apply to all users. If you have any questions, please contact us on hello.untitled@talenthouse.com.

Talenthouse IP, LLC, a company registered under company number 6268714, whose registered office is 827 Santa Barbara Dr., Farmington, NM, 87401, USA, together with its group companies, operates the platform available at the site www.untitled.talenthouse.com and all its sub-domains and iterations (including, where available, the mobile and tablet apps) (together “Untitled”, “Talenthouse”, “we”, “us” or “our”).

Untitled is a global creative community platform, for Educators, Parents/Guardians and Young Creators between 7 and 18 years old who want to take part in our Creative Briefs and submit Work, and access learning resources and materials.

Young Creators

We use the age of digital consent in the country where you live to determine what functionality you have on the Untitled and to decide who requires permission from a Parent/Legal Guardian. If you are under the age of digital consent in the country you live, you will need permission from a Parent/Legal Guardian to create an account.

Your Parent/Legal Guardian will also be responsible for signing any legal documents needed for you if you are under the age of 18. There are different Website users and there are different registration processes for each of these. You can enjoy Untitled, even if you do not have an account, but you cannot submit for any Creative Briefs ‘Work’ without an account.

Content and Intellectual Property

We provide ‘Content’ to you such as text, illustrations, files, images, scripts, graphics, music, sounds, photographs, videos, information content, URLs, interactive features, documentation, or other materials. This is not the same as User Generated Content (‘UGC’) which is what you generate for example when you submit Creative Briefs, or upload to your profile. You can share your UGC on your own social channels from Untitled where the functionality of the website allows it.

We also provide ‘Technology’ which is all underlying software or technology used in connection with our Services and the Website.

We own the Content and the Technology. You are not allowed to use it without our permission. If you would like to use any of these, you must first obtain written permission from us by contacting us at hello.untitled@talenthouse.com. We do not have to give you permission is we choose not to.

When you use intellectual property, which belongs to someone else, you must have a licence. We are not giving you a licence to use all our Content and Intellectual Property, or anyone else’s. However, we want you to use and enjoy Untitled for your personal use or for educational purposes. You must not use data mining, robots, scraping or similar data gathering or extraction method.

At times you will be able to download and/or print Content. When you do this, you must keep the copyright notice: “Copyright © 2022, Talenthouse IP, LLC, All rights reserved.”

Please do not share our Content in any way on the internet or elsewhere. As we have said, your UGC can be shared by you. Please be careful, and do not use other people’s work, images or ideas, or any company images or trademarks. If you do there could be consequences and, only you will be responsible for this.

Please do not copy, imitate or use any of our Content in such a way that causes confusion with our users, customers and clients. Please be careful with what UGC you post or upload and take care that it is not disparaging of us, the companies in the group, Untitled or our client’s, users’ customers, or suppliers.

You must create an account if you are an Educator, Parent/Legal Guardian or Young Creator using the Website. Young Creators below age of digital consent need permission from a Parent/Legal Guardian to participate in the Creative Briefs and submit Work on this Website. When you create an account, you will be required to provide personal Registration Information. Permission from a Parent/Legal Guardian is required where you are below the age of digital consent in the country where you live and they will need to sign contractual documentation if you are under 18 years old. Where you are above the age of digital consent in the country where you live, you will have greater functionality on the website, and you can for example edit your own profile and submit Work in response to Creative Briefs and agreeing to the Official Rules yourself.

You must give accurate, current and complete Registration Information and, if any Registration Information changes you must update it. If a Parent/Legal Guardian’s email address is required for your account to be activated, please check that it is correct.

If we suspect that your Registration Information is inaccurate or incomplete, or your use is suspicious we may suspend or terminate your account.

Your username and password are for you to log into the Website, and for your personal use only. You are responsible for it. You must keep your password and account information confidential.

If you think anything suspicious is happening with your account, or someone is using it that shouldn’t be please email us on hello.untitled@talenthouse.com.

Remember to log out of your account at the end of each session.

If you do not make an account, your use will be limited to “read-only” rights and you will not be able to utilize all aspects of the Services and you will not be able to submit any Work.

Creative Briefs

Among the Services offered by the Website there are various Creative Briefs which registered users can participate in by submitting Work. Official Rules are applicable to the Creative Briefs (the ‘Official Rules’). The Official Rules of a Creative Brief include additional terms that apply to the Creative Brief if you choose to participate.

If the Official Rules say something different to these Terms, or a Creative Brief the Official Rules will apply.

Most Creative Briefs will require that the brand Sponsor is able to share any submitted Work on their owned social and digital channels from Creative Brief launch, for up to 3 months from the Selected Creator Announcement. This is a 3-month, non-exclusive, digital and social only license. The brand Sponsor will credit Untitled where work is used, and the user or Young Creator, AS LONG AS permission is provided by the Young Creator or their Parent/Legal Guardian.

All Creative Briefs will set out the licencing that applies to any Work summitted and the licencing that will apply to any selected Work. Licensing of selected Work will vary across the Creative Briefs but will always be clearly stated on the brief page and in the Official Rules. See the ‘How will my work be used?’ section of each Creative Brief for full details.

Where licensing will be longer than 3-months, and for both submitted Work and selected Work a Parent/Legal Guardian will be required to sign a License Agreement on behalf of the Young Creator in they are under the age of 18.

If your Work is selected, Untitled will contact the user or Selected Creators for each Creative Brief via email. This will either be an email to the Parent/Legal Guardian via the email address provided when permission to participate in Creative Briefs was granted (for Young Creators below18 years of age), or the Young Creator themselves (if above 18 years of age).
